Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of https://primebyte.co.za (the “Site”) and any purchase made through it. The Site is operated by PrimeByte Solutions (PTY) Ltd (“PrimeByte Solutions”, “we”, “us”, “our”), a company registered in South Africa.

By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Who Can Use This Site

You must be at least 18 years old, or have the consent of a parent/guardian, to place an order on this Site. By placing an order, you confirm that the information you provide is accurate and that you are legally able to enter into a binding contract.

We sell to both consumers and businesses. Where you are purchasing as a business, certain consumer protections under the Consumer Protection Act 68 of 2008 (“CPA”) may not apply in the same way as they do for private consumers — see Section 8 below.

2. Products & Descriptions

We sell IT hardware, software, electrical products, and related accessories. We make reasonable efforts to ensure product descriptions, images, specifications, and pricing on the Site are accurate. However:

  • Product images are for illustrative purposes and may differ slightly from the actual item (e.g. packaging updates by manufacturers)
  • We reserve the right to correct any errors in pricing or product information, even after an order has been placed, and will notify you before processing an order affected by such an error
  • Availability is not guaranteed until your order is confirmed; in rare cases of stock discrepancies, we will contact you with alternatives, a backorder option, or a full refund

3. Orders & Guest Checkout

You may check out as a guest or create an account — an account is not required to place an order.

Placing an order constitutes an offer to purchase, which we may accept or decline (for example, in cases of suspected fraud, pricing errors, or stock unavailability). A contract is only formed once we confirm your order.

4. Pricing & Payment

  • All prices are displayed in South African Rand (ZAR).
  • Prices displayed do not include VAT, as PrimeByte Solutions is not currently VAT-registered. 
  • Payment is accepted via EFT/bank transfer. We are also in the process of enabling card payments and additional payment options (such as Payflex and SnapScan) via a third-party payment gateway [gateway name to be confirmed — pending approval from PayFast, Ozow, and/or Stitch]. Accepted methods will be displayed at checkout.
  • Orders paid via EFT will only be processed once payment has been received and confirmed in our account. Orders paid via card or other gateway methods will be processed once payment is confirmed by the gateway.
  • We reserve the right to add or change accepted payment methods at any time.

5. Delivery

  • We deliver within South Africa via The Courier Guy, or other courier services we may use from time to time.
  • Estimated delivery timeframes are provided at checkout or in your order confirmation but are not guaranteed — delays caused by the courier, weather, or circumstances outside our control are not our responsibility, though we will assist in tracking and resolving delivery issues where we can.
  • Risk in the goods passes to you upon delivery to the address you provided. Please ensure your delivery address and contact details are accurate.

6. Returns, Refunds & Warranty

Our Returns & Refunds Policy and Warranty Policy, published separately on the Site, form part of these Terms. In summary, and in accordance with the CPA and Electronic Communications and Transactions Act 25 of 2002 (“ECTA”):

  • Consumers have the right to cancel an order and return goods within a specified period for online/distance purchases, subject to the conditions in our Returns & Refunds Policy
  • Goods that are defective, or do not match their description, may be returned in accordance with your statutory rights
  • Business customers may be subject to different return terms — see our Returns & Refunds Policy for details.

7. Intellectual Property

All content on this Site — including text, graphics, logos, product images, and site design — is owned by or licensed to PrimeByte Solutions (PTY) Ltd, unless otherwise indicated (e.g. manufacturer images/branding), and may not be copied, reproduced, or used without our prior written permission.

Software products sold through this Site remain subject to the license terms of their respective publishers/manufacturers, which take precedence over these Terms with respect to software use.

8. Consumers vs. Businesses

Where these Terms or our other policies refer to rights under the CPA, those specific consumer protections apply to natural persons purchasing for personal use, in accordance with the CPA’s scope. Business customers (juristic persons, or purchases made for business/resale purposes) may not benefit from certain CPA provisions in the same way, and standard contract terms will apply instead. If you are uncertain which applies to your purchase, please contact us before ordering.

9. Limitation of Liability

To the maximum extent permitted by law:

  • PrimeByte Solutions (PTY) Ltd will not be liable for any indirect, incidental, or consequential loss arising from your use of the Site or purchase of products, except where such liability cannot be excluded under the CPA or other applicable law
  • Our total liability in respect of any order is limited to the value of that order
  • We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g. courier delays, supplier stock shortages, load shedding, or other force majeure events)

Nothing in these Terms limits any right you have under the CPA that cannot lawfully be excluded.

10. Website Use

You agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorised access to the Site, its systems, or other users’ accounts
  • Interfere with the proper functioning of the Site

We may suspend or terminate access to the Site for any user who breaches these Terms.

11. Privacy & Cookies

Our collection and use of your personal information is governed by our Privacy Policy and Cookie Policy, which form part of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes will first be attempted to be resolved informally by contacting us directly; unresolved disputes may be referred to the applicable consumer protection bodies (e.g. the National Consumer Commission) or the courts of South Africa.
